Terms & Conditions

Please read these Terms and Conditions carefully before using our website or booking any of our programmes. By using the website or booking a session, you agree to be bound by these terms. If you have questions, contact us at [email protected].

1. Definitions

  • "Kithora", "We", "Us", "Our" — refers to the operator of this website and provider of the programmes described herein, registered as a sole proprietorship in Sabah, Malaysia.
  • "Website" — the website accessible at the domain associated with this page.
  • "Programme" or "Service" — any of the educational workshops or coordination sessions offered by Kithora, including the Courtyard Conversations Workshop, the Shared Information Organisation Session, and the Family Harmony Coordination Programme.
  • "Participant" or "You" — any individual who uses the Website or books or attends a Programme.
  • "Agreement" — these Terms and Conditions as amended from time to time.

2. Acceptance of Terms

By accessing the Website or booking a Programme, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction if higher), that you have the legal capacity to enter into this Agreement, and that you agree to these Terms and Conditions in full. If you do not agree, you must not use the Website or book any Programme.

3. Description of Services

Kithora provides educational workshops and practical information organisation sessions for families. All Programmes are non-advisory in nature. Nothing provided through our Programmes constitutes legal advice, financial advice, counselling, psychological treatment, or any form of professional regulated service. Participants are encouraged to consult appropriately qualified and licensed professionals for personal legal, financial, or therapeutic matters.

Our Programmes are currently offered in person at our premises in Kota Kinabalu, Sabah, Malaysia. Availability is subject to scheduling and may change without notice.

4. Bookings and Participant Responsibilities

When booking a Programme, you agree to:

  • Provide accurate and complete contact information.
  • Attend sessions at the agreed time, or provide reasonable advance notice if you are unable to attend.
  • Conduct yourself with respect towards other participants and Kithora facilitators during sessions.
  • Not record sessions (audio, video, or otherwise) without prior written consent from Kithora and any other participants present.
  • Not use information shared by other participants in sessions for any purpose outside the educational context of the Programme.

5. Payment Terms

All fees are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless otherwise stated. Current Programme fees are:

  • Courtyard Conversations Workshop: RM 600 per session
  • Shared Information Organisation Session: RM 2,100 per session
  • Family Harmony Coordination Programme: RM 4,420 (full programme)

Payment terms and accepted methods will be confirmed at the time of booking. We reserve the right to adjust fees with reasonable notice.

Cancellations and rescheduling: Please notify us at least 48 hours before your scheduled session to reschedule without charge. Cancellations with less than 48 hours' notice may incur a partial fee. We reserve the right to cancel or reschedule sessions due to unforeseen circumstances, in which case we will offer a full reschedule or refund.

6. Intellectual Property

All content on the Website — including text, design, logos, session guides, templates, and frameworks — is the intellectual property of Kithora or its licensors and is protected under Malaysian law. You may view and print content from the Website for your personal, non-commercial use only. You may not reproduce, redistribute, adapt, or commercially exploit any content without prior written permission from Kithora.

Materials provided to participants during Programmes (such as take-home guides, checklists, and binders) are licensed for personal use by the participant only and may not be reproduced or shared commercially.

7. Disclaimers

Kithora's Programmes are educational and organisational in nature. We make no representation that participation in any Programme will result in any particular outcome for your family, legal situation, financial position, or personal wellbeing.

The Website and its content are provided on an "as available" basis. We do not warrant that the Website will be free from errors, interruptions, or security vulnerabilities, though we take reasonable steps to maintain it.

Nothing on the Website or in our Programmes constitutes professional legal, financial, tax, or therapeutic advice. Always seek advice from qualified professionals for such matters.

8. Limitation of Liability

To the fullest extent permitted by law in Malaysia, Kithora shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Website or participation in our Programmes, including but not limited to loss of income, data, or family-related outcomes.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the specific Programme to which the claim relates.

We are not liable for events outside our reasonable control, including natural disasters, utility failures, civil disturbances, or public health measures that prevent delivery of a session.

9. Confidentiality

Kithora treats all information shared by participants in sessions as confidential and handles it in accordance with our Privacy Policy. Participants similarly agree to treat information shared by other participants during group sessions as confidential and not to disclose it to third parties without consent.

10. Termination

Either party may end a Programme arrangement by giving reasonable written notice. If you cancel after a session has commenced, fees for completed sessions are non-refundable unless the cancellation is due to a material breach by Kithora.

Kithora reserves the right to refuse or discontinue service to any participant whose conduct is disrespectful, disruptive, or otherwise incompatible with a safe and productive session environment.

11. Dispute Resolution

We hope to resolve any concerns directly and informally. If you have a complaint, please contact us at [email protected] and we will respond within 14 days.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing formal legal action. These Terms are governed by the laws of Malaysia, and any legal proceedings shall be subject to the jurisdiction of the courts of Sabah, Malaysia.

12. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kithora regarding use of the Website and Programmes.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
  • Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations to a successor business.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where changes are material, we will make reasonable efforts to notify you. Continued use of the Website or booking of Programmes after changes are posted constitutes acceptance of the revised Terms.
